Divorce? What does it means for you and for your family?
There are 4 main areas that make up a divorce and you may need find you need help with different aspects at different times.
- Legal Divorce after Separation – this is the actual divorce process, which is legally known as dissolution of marriage. This is handled by the family court.
- Money Matters – this is the division of property, financial assets, possessions or the division of debt that was accumulated during your marriage.
- Child Custody – this is a legal term referring to care of the children. Everything concerning the children can be decided upon between you and your ex-partner and it does not need a legal document. If you are unable to agree then the family court has a variety of avenues to help you with this process.
- Child Support – refers to ongoing payments made between parents for the care of the children. This can be decided upon between you and does not need a legal document. There are guidelines set out by the IRD. You can ask the IRD to decide the amount and also organise transfer of payments of child support if you are unable to agree.
You may notice that two of the main parts, the child support and child custody do not require any legal documentation if you are able to decide these aspects between you. It is therefore important to be able to communicate these two aspects to save both you and your partner a lot of anguish and money.
